📃 TERMS OF USE

OVERVIEW

The Cheppy application ("Service") is an interactive English learning platform developed by the Cheppy Development Team to enhance foreign language proficiency and promote digital transformation in education through the application of Artificial Intelligence.

1. INTRODUCTION

1.1. These Cheppy Terms of Use ("Agreement") include the terms, conditions, personal data processing notices, and regulations governing the use of the Service, owned, operated, and managed by the Cheppy Development Team ("we").

1.2. . By continuing to access or use the Service, the User confirms that they have read, understood, and agreed to comply with all provisions of this Agreement. If the User does not agree with any term, please cease using the Service.

1.3. The User establishes legal consent to this Agreement and all related policies applied in conjunction, including the Privacy Policy and any policies updated over time (if applicable).

1.4. If the User does not agree to provide or does not meet the conditions to share the information required to use the Service, we reserve the right to deny or terminate the User's access to and use of the Service.

1.5. . We may revise or update the content of these Terms of Use at any time without prior notice. Continued use of the Service after the Terms of Use have been updated constitutes the User's acceptance of those changes.

2. INTELLECTUAL PROPERTY

2.1. All content, screens, designs, technical features, source code, processed voice data, learning materials, automated assessment systems, and other components of the Service are intellectual property owned by us and protected under intellectual property law.

2.2. Any unauthorized copying, modification, distribution, transmission, publication, exploitation, or use of any part of the Service for commercial or non-commercial purposes is strictly prohibited without our prior approval.

2.3. Users must not engage in any conduct that may infringe our intellectual property rights, including disassembling or reverse-engineering the source code, copying learning content, or reusing data from the system.

2.4. In the event of a detected violation, we reserve the right to take necessary legal action, including demanding the cessation of the infringing conduct and claiming damages where applicable.

2.5. Copyright of Exercise Content
All exercises, questions, interactive scenarios, and recommendation algorithms developed by the system are protected as our exclusive intellectual property. Any form of copying, citation, reproduction, adaptation, or use of this content for any purpose without our written permission is strictly prohibited.

2.6. Copyright of Character Artwork
All images, character icons, and graphic elements within the Service are owned by us or duly licensed. Users may not copy, reproduce, modify, or use these images outside the scope of the Service without a written copyright agreement.

3. ACCOUNTS AND SECURITY

3.1. To fully access the Service's features, Users must create an account and provide truthful, complete, accurate, and regularly updated information. Users bear full responsibility for the information provided.

3.2. Each account is unique and tied to one User. Users are responsible for maintaining the confidentiality of their login credentials (including username, password, and verification code if applicable) and for restricting access to their device.

3.3. All activities originating from a User's account are deemed to have been performed by that User. If unauthorized access or a security breach is detected, the User must immediately notify us for assistance.

3.4. We reserve the right to suspend, revoke, or terminate an account if a violation of the Terms of Use, fraud, impersonation, or a threat to system security is detected.

3.5. Users may not create an account on behalf of another person, use a false identity, or use an account for fraudulent, disruptive, or system-interference purposes.

4. USER-GENERATED CONTENT

4.1. When using the Service, Users may create or submit content including but not limited to voice recordings, exercise responses, interactive content, and feedback.

4.2. Users understand and agree that the Service may use User behavioral content for the purposes of improving service quality, training artificial intelligence systems, personalizing the learning experience, and for internal research and statistical objectives.

4.3. Users commit to taking responsibility for the content they provide, ensuring it does not violate the law, and does not contain false, offensive, threatening, inappropriate, or third-party-rights-infringing material.

5. . PROHIBITED CONDUCT

5.1. Copying, modifying, reproducing, publishing, distributing, or creating derivative works from the application's content, data, or features without authorization .

5.2. Renting, sublicensing, disclosing, or transferring content or data within the application to third parties, except for content lawfully owned by the User themselves

5.3. Altering, removing, or misrepresenting rights statements, intellectual property marks, or system content displayed within the application

5.4. Interfering with, disrupting, sabotaging, or gaining unauthorized access to Cheppy's technical systems, including spreading malware, viruses, or conducting cyberattacks.

5.5. Using unauthorized software or tools to access or interact with the application.

5.6. Uploading, storing, or transmitting content that is illegal, defamatory to individuals or organizations, contrary to public morality, or in violation of intellectual property rights

6. INFORMATION SECURITY

6.1. We continuously strive to protect Users from information security threats. Technically, the Platform consistently integrates robust and advanced security features to ensure that User account information is stored and processed securely.

6.2. However, Users acknowledge that the level of security also depends on the device being used, the User's internet or internal network connection, and other factors that are the responsibility of third parties. Users understand and accept the security risks (if any) associated with using the Service.

6.3. . We are committed to protecting the privacy and security of User information.

7. CHANGES AND UPDATES

7.1. When necessary, we may amend, update, or adjust the content of this Agreement at any time, and the latest version of the Agreement will be posted on our official Platform. Users agree to periodically and proactively review the Terms of Use section on the Platform to stay informed of the most recent updates.

7.2. In the event that one or more provisions of this Agreement conflict with Vietnamese law, the relevant provision(s) will be amended to comply with current legal regulations, while the remainder of the Agreement retains its full effect.

8. RIGHTS AND RESPONSIBILITIES OF CHEPPY

8.1. Rights of Cheppy

• Update, modify, improve, or discontinue any content, feature, or service on the platform without prior notice.

• Suspend, disable, or delete a User account if a violation of the Terms of Use, signs of fraud, impersonation, or a threat to system security is detected.

• Collect, process, and analyze User data for the purposes of product development, personalizing the learning experience, and internal research, in accordance with applicable law.

8.2. Responsibilities of Cheppy

• Protect Users' personal information in accordance with security standards and applicable legal regulations.

• Provide services that are continuous, secure, and appropriate for educational purposes.

• Respond to requests, complaints, and provide timely technical support to Users and parents/guardians.

• Ensure transparency in all policies and terms, and promptly notify Users of any changes.

9. RIGHTS AND RESPONSIBILITIES OF USERS

9.1 Rights of Users

• Access, correct, or request deletion of their personal information.
• Decline or adjust the level of information sharing, notification settings, or device access permissions.
• Submit complaints or contact Cheppy for support in cases involving security concerns, privacy issues, or service quality problems..

9.2 Responsibilities of Users

• Provide accurate and complete information when registering an account or using the service.
• Keep login credentials confidential, and not share accounts or impersonate others.
• Not use the Service for illegal purposes, to disrupt the system, or to infringe upon the rights of third parties.
• Proactively update to the latest version of the application to ensure optimal performance and security.

10. THIRD-PARTY RESPONSIBILITIES

10.1. Third parties may include:

Technology partners, server infrastructure providers, technical data processors, contractors performing statistical analysis, payment platforms (if applicable), and advertisers (with clearly defined scope).

10.2. Primary responsibilities:

• Commit to securing information shared by Cheppy in accordance with the relevant contract or non-disclosure agreement.
• Not use User information for commercial purposes without the explicit consent of the User or Cheppy.
• Comply with personal data protection requirements, technical standards, and applicable legal regulations.

11. DISCLAIMER OF LIABILITY

Cheppy shall not be liable for any damages arising from:

• Misuse of the Service by the User, or unauthorized sharing or disclosure of account credentials.
• Technical incidents beyond our reasonable control, including loss of network connectivity, device hardware failure, or sabotage by third parties.
• User-generated content (e.g., recordings, images, messages) that negatively affects the User themselves or others.
• The User's violation of the Terms of Use, the Privacy Policy, or applicable law.
• The use of data by third parties not designated or managed by Cheppy.

12. HANDLING OF VIOLATIONS

If the User breaches any provision of this Terms of Use, we reserve the right to immediately suspend or terminate the account without prior notice. Subject to the nature and severity of the breach, the User may be requested to verify their identity, remove the non-compliant content, or be subject to legal action under applicable laws. The User shall bear full liability to us, affiliated parties, and relevant authorities for any and all damages arising from such breach .
